Services, booking and start

UYA Coaching currently includes UYA Session One, Core Coaching and Concierge Coaching, as well as any other coaching service expressly offered under the UYA Coaching name.

The description, price and main features of the service are shown before purchase. Any service-specific arrangements shown before purchase and confirmed in your booking confirmation, invoice or service confirmation form part of your agreement with UYA Coaching.

A booking is confirmed when your booking and payment have been accepted, unless agreed otherwise.

​

UYA Session One

UYA Session One is the starting point of a new UYA coaching relationship. It includes preparation before the session, a live online coaching session and written feedback afterwards.

​

The service begins shortly after booking. You will normally receive preparation materials within a few days. 

​

Core Coaching and Concierge Coaching

Core Coaching and Concierge Coaching are ongoing coaching trajectories rather than collections of individually purchased sessions. They follow UYA Session One and may include an agreed number of live coaching sessions, a defined service period, preparation, reflection and, where included in the service purchased, contact between sessions.

The specific duration, number of sessions, level of between-session contact and other arrangements are stated before purchase or confirmed separately in writing.

​

Purchasing a follow-on coaching trajectory before completing UYA Session One does not change this sequence. The trajectory begins after Session One has been completed.

​

Coaching Agreement

The UYA Coaching Agreement governs the professional coaching relationship. It must be signed before the first live coaching session takes place. Unless otherwise agreed, the same Coaching Agreement continues to apply to further UYA Coaching services.

​

Fees and payment

The price of the service is shown before purchase. Unless agreed otherwise, UYA Coaching services are paid in advance.

​

For Core Coaching, Concierge Coaching or another ongoing service, the agreed fee applies to the coaching trajectory as a whole and not to a series of separately purchased individual sessions. Any service-specific payment arrangements will be shown before purchase or confirmed in writing.

​

Cancellation and rescheduling of scheduled sessions

A scheduled coaching session can be cancelled or rescheduled up to 48 hours before the agreed start time.

If you cancel or reschedule within 48 hours, the session may be charged in full or, where it forms part of a prepaid coaching trajectory, treated as a used session. Genuine emergencies will be considered reasonably and individually.

If UYA Coaching needs to reschedule a session, you will be informed as early as reasonably possible and offered another suitable time.

​

This section concerns individual scheduled appointments. It does not affect any statutory withdrawal, termination or other mandatory rights that apply to you by law.

​

Consumer rights and right of withdrawal

If you purchase coaching as a consumer, you retain any mandatory consumer rights that apply to you under applicable law.

Nothing in these Terms & Conditions excludes or restricts rights that cannot legally be excluded or restricted.

​

EU consumers

If you are a consumer in the European Union and purchase a UYA Coaching service online, you generally have a statutory 14-day right of withdrawal from the date the contract is concluded. You do not need to give a reason for exercising this right.

​

The 14-day withdrawal period applies to the service or coaching trajectory purchased. A new withdrawal period does not arise for each individual coaching session within the same trajectory.

​

Starting during the withdrawal period

UYA Coaching services may begin during the 14-day withdrawal period. At checkout, you will be asked separately to expressly request and agree that UYA Coaching may begin providing the service during that period.

​

If you withdraw after performance has begun at your express request, you may be required to pay an amount proportionate to the part of the service already provided up to the time you inform us of your withdrawal.

​

Depending on the service purchased, performance already provided may include preparation, coaching sessions and other agreed elements of the service that have actually been provided.

​

If the booked service is fully performed during the withdrawal period, your right of withdrawal ends after full performance if you:

• expressly requested and agreed that performance could begin during the withdrawal period; and

• acknowledged that your right of withdrawal would end once the service had been fully performed.

​

How to withdraw

Where a statutory right of withdrawal applies, you may exercise it:

• through the Withdraw from a booking function at www.useyouraddiction.com/[withdrawal-page];

• by emailing info@useyouraddiction.com; or

• by using the Model Withdrawal Form at the end of these Terms & Conditions.

​

You do not have to use the Model Withdrawal Form. A clear statement that you wish to withdraw is sufficient.

If you use the online withdrawal function, you will receive electronic confirmation of your withdrawal without undue delay.

Where a refund is due following a valid withdrawal, it will be made without undue delay and no later than 14 days after UYA Coaching is informed of your withdrawal, normally using the same payment method you used for the original transaction unless otherwise agreed.

If performance began during the withdrawal period at your express request, any amount lawfully due for the part already provided may be deducted from the refund.

​

Ongoing coaching and early ending of a trajectory

UYA Session One does not commit you to further coaching.

​

Core Coaching and Concierge Coaching are offered as complete coaching trajectories with an agreed scope, duration and price. The agreed fee applies to the trajectory as a whole and not to individually purchased sessions.

​

After the applicable 14-day withdrawal period has ended, ending a coaching trajectory early does not automatically entitle you to a refund for unused sessions, time or availability, unless otherwise agreed or mandatory law provides otherwise.

​​

Concierge Coaching is an ongoing coaching service and may be ended by you or UYA Coaching by giving one month’s written notice. The notice period starts on the day the written notice is received. The service continues during the notice period and the agreed fee remains payable.

​

Any service period, scheduling arrangements and between-session availability will be shown before purchase or confirmed in writing. Unless otherwise agreed, unused sessions or included availability do not automatically carry over beyond the agreed service period.

​

UYA Coaching may decide not to begin further coaching, or may pause or end an ongoing coaching trajectory, where the support required falls outside the scope of coaching, where there is a safety or professional-boundary concern, or where continuing would no longer be appropriate or responsible.

​

If UYA Coaching ends a coaching trajectory, any financial consequences will be determined according to the circumstances and applicable mandatory law.​

​

Responsibility and liability

Coaching is a shared process and does not guarantee any particular outcome. You remain responsible for your own decisions, choices and actions.

 

UYA Coaching will provide its services with reasonable care and professionalism. To the extent permitted by law, UYA Coaching is not liable for loss or damage resulting from decisions or actions you take following coaching.

Nothing in these Terms & Conditions limits any mandatory rights you have as a consumer.

​

Governing law and disputes

These Terms & Conditions are governed by Dutch law.

​

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protection that applies to you under applicable law.

​

If a disagreement arises, you and UYA Coaching will first try to resolve it directly and reasonably.

Where appropriate, mediation or another suitable form of dispute resolution may be considered.
